Letter-from-bailiff

Letter help illustration

I have received a letter from a bailiff, what do I do?

Open it, read it, and take action. Ignoring a valid letter can lead to a visit and extra fees. Here’s what to check and what to do now.

First of all, please DO NOT ignore the letter…

Not sure it’s valid? Call us on 0161 527 7531 and we’ll check it with you.

Step 1. Check if it’s a Notice of Enforcement

If you ignore a valid notice, a bailiff can visit after 7 clear days and fees will be added.

Is the letter a Notice of Enforcement?

If the letter states “Notice of Enforcement” and you ignore it, a bailiff can attend after 7 days as well as add enforcement fees.

To be valid, the notice should:

  • Show your correct name and address.
  • State what debt you owe and the correct amount.
  • Explain that you are being given 7 days’ notice before a bailiff may visit.
  • Come from a registered bailiff (not a debt collector).
  • Be sent by post, fax, email, delivered by hand, or fixed to your door if you have no letterbox.
  • Be written in the required legal style for notices of enforcement.

If you’re unsure whether it’s valid, call 0161 527 7531 for assistance.

When will the bailiff visit — and what to do beforehand

After a valid notice is received, the bailiff must wait 7 clear days before visiting. This does not include bank holidays, Sundays, the day you received the letter, or the day of the visit.

If the “notice” is from a debt collector, it isn’t a valid notice of enforcement and doesn’t give them bailiff powers.

Before any visit, contact the bailiff office (details on the letter) to discuss payment or a plan. If you cannot pay in full, say you are arranging help and will be in touch — or call us and we’ll guide you.

Important reminders

  • Do not let anyone in unless you are sure who they are and why they are there.
  • Ask for ID through a window/letterbox or by phone; a bailiff must carry ID.
  • Keep doors and windows locked; move vehicles into a garage or away from the home.
  • You do not have to pay on the doorstep.
